A bus gate should always be accompanied by signage stating that you're not permitted to drive past, so to some extent it's irrelevant, however I do agree with you that this whole bus gate situation has got a bit out of hand. It seems to simply be a way for the councils to spend less money on clearly marking bus lanes.
